  WCRR2008 Participation Rules

Article 1 (Parties)
(1) The Exhibition as it is used in this document refers to Commercial Exhibition at the 8th World Congress on Railway Research.
(2) The Organizer as it is used in this document refers to WCRR 2008 Host Organizations, KORAL, Korea Rail Network Authority(KRNA), and Korea Railroad Research Institute(KRRI) and any duly authorized representative or employees of the foregoing Congress.
(3) The Exhibitor as it is used in this document refers to the companies, associations or organizations licensed to exhibit at Exhibition.

All exhibitors shall be primary contracts for compliance with this Exhibition Contractual Agreement, including giving and receiving formal notice as specified herein, before, during and after the Congress.

Article 2 (Application and Agreement)
(1) The Agreement of participation in Exhibition shall be designated in the submission of the written Application Form and be accompanied by a 50% of payment of the total cost of the exhibit space rental to the Organizer.
(2) The Organizer shall determine the eligibility of any company, product, service or application for exhibition.

Article 3 (Assignment and Reassignment of Space)
(1) The Organizer reserves the right to determine the official floor plan and to assign all or any part of the space hereinabove described for the Purpose of the Congress or with for any other reasons.
(2) The Organizer reserves the right to alter the official floor plan and to reassign all or any part of the space based on the agreeable reasons. The judgment of the Organizer in this matter shall be final and the Exhibitor waives any and all damages and claims for those of any alteration or reassignment.

Article 4 (Rates and Payment)
(1) The Exhibit rates are as described in Application Form.
(2) The application for the Exhibition must be made online, www.wcrr2008.org, and be accompanied by a 50% of payment of the total cost of the exhibit space rental within 2 weeks after the online application.
(3) 100% of the balance owing is due April 29, 2008. Applications submitted after April 15, 2008 must be accompanied by payment in full.

Article 5 (Management of Space)
(1) The Exhibitor must, at his or her own expense, maintain, secure and keep in good order the assigned exhibit space and those of any exhibiting materials.
(2) The Exhibitor and their agents may not make sales or take orders in the display area.
(3) The Organizer reserves the right to refuse admittance to and to eject from the exhibit area any person or persons engaged in objectionable behavior.
(4) The Exhibitor shall not share, delegate, or sublet any part or whole of the allocated space without the prior written consent of the Organizer.
(5) Nothing should be posted on, attached, nailed, painted, screwed or otherwise attached, columns, walls, floors, ceilings or other part of the building, furniture or booth provided. The Exhibitor will be responsible for injury, loss or damage to persons, building, furniture, goods, equipment or decorations, caused by accident, loss, or any other cause as specified herein, before, during and after the scheduled event.

Article 6 (Installation and Removal)
Installation and Removal of exhibits shall be completed within the scheduled time specified by the Organizer, and the Exhibitor will be responsible for whole and any part of loss or damage incurred by the delay during installation and removal of exhibits.

Article 7 (Provision of Information)
The Exhibitor shall be fully responsible to provide the Organizer with the information of their promotional activities and materials, display goods or services, equipments, advertise materials, installation, and removal.

Article 8 (Insurance, Security and Safety)
(1) The Exhibitor must carry appropriate insurance to cover display materials and equipments against damage and loss during installation, Congress period and removal.
(2) Every reasonable precaution will be taken to protect exhibitor¡¯s property during installation, Congress period and removal. However, the Organizer will not accept responsibility for injury to persons or loss of or damage to products, exhibits, equipment or decorations by fire, accident, theft or any other cause while in COEX.
(3) The Exhibitors waive any and all damages and claims for those of injury to persons or those of loss or damage to precuts, exhibits, equipment or decorations by fire, accident, theft or any other cause while in COEX.
(4) All materials used for exhibits must be fire resistant in compliance with fire safety regulations, and the Organizer reserves the right to require the immediate withdrawal or restriction of installation or an exhibit if it may be injurious to the safety of the Congress.

Article 9 (Limitation of Display Materials)
The Organizer may forbid installation or request removal or discontinuance of any exhibit or promotion, wholly or in part, that, in its opinion, is not in keeping with the character or purpose of the Congress, or if the Exhibitor and their agents make sales or take orders in the display area without the consent of the Organizer.

Article 10 (Termination / Reduction / Cancellation)
(1) The Organizer reserves the right to terminate exhibits if the Exhibitor do not use all or any part of the space assigned for any reason whatsoever, or if the total cost of the booth space rental is not paid within specified period described hereinabove. There will be no return for a 50% of payment of the total cost of the exhibit space rental upon any termination as aforesaid.
(2) In the event of cancellation by the Exhibitor for any reason whatsoever provided that cancellation is received, in writing, prior to April 15, 2008. There will be no return for a 50% of payment of the total cost of the exhibit space rental upon any cancellation as aforesaid.
(3) In the event of cancellation by the Exhibition after April 16, 2008, the Exhibitor must pay in full.
(4) The cancellation conditions hereinabove also apply in the case of booth space reduction.

Article 11 (Supplementary Clauses)
(1) The Organizer reserves the right to issue the supplementary regulations and instructions in addition to this Exhibition Contractual Agreement and all such additional written regulations and instructions from a part of this Agreement and is binding on all exhibitors.
(2) The Exhibitor shall be primary contracts for compliance with COEX Exhibition Hall Rules and Regulations.

Article 12 (Standard Resolution of Dispute)
Any controversy of claim arising out of or relation to this contract, or the breach thereof, shall be settled by binding arbitration in accordance with the Korean Commercial Arbitration Board, and judgment upon the award rendered by the arbitrator(s) may not be entered in any court of competent jurisdiction.
